Is Orange County's new law banning registered sex offenders from county-owned parks a bust?

Last year, in a closely watched case, Hugo Godinez, a registered sex offender from Santa Ana, was found guilty of entering Fountain Valley's Mile Square Park, a misdemeanor offense that earned him 100 days in jail and five years of formal probation.

But, two weeks ago, an Orange County Superior Court appellate panel overturned the conviction, saying the county park ban was trumped by a similar but less restrictive state law. The panel sent the case to the Court of Appeal.

But District Attorney Tony Rackauckas remains undeterred. On Thursday, he issued a statement saying the Godinez ruling "does not apply to other pending or future prosecutions" resulting from the O.C. law.

"We will continue to review cases involving sex offenders in parks as they are presented on a case-by-case basis," Rackauckas said. "We also hope to present our position concerning preemption to the Court of Appeal and receive its decision on this important issue.”

Somme day Eric when you get your "big boys" pants you will learn there are many of us who dont take kindly to having our children being used as sexual food for deviants who are too stupid to keep their zippers up.. Someday you will learn its "natural selection " that fuels a healthy society and freaks who use kids to "get off" are not uppermost in the food chain... you read my lips and you read them good.. I will go to my grave taking you freaks down.. and I have a boat load of lawyers and parents who stand behind me!!!

So, Valerie, your solution is to keep using the registry to harass offenders and their families until they snap? Brilliant strategy for keeping society safe. Charged for felony assault makes you more dangerous to society than over 70% of the people on the registry, but you don't give a rip. Just to clarify, I am involved with several different organizations including 2 different prosecutor organizations, 7 state-level law enforcement directives, 3 victims groups, and every city police department in my own area (more than 32 of them at last count). If you care to compare credibility factors, I'm more than willing. Perhaps the author of this report would be interested in having a three-way interview so he can make his own determination.

Eric, didn't you know that there is a sex offender behind every bush in our parks just waiting to reviolate??? heh. These hand wringers apparently don't want to ban them from churches, malls, homes with children, circuses, pizza parlors, parades or beaches. That, of course, would be unconstitutional. Only from parks where probably less than 2% of sexual offenses against children occur. So let's throw another piece of raw red meat into the pool of sharks and watch them go into a frenzy!!! heh. :^)

"Charged for felony assault makes you more dangerous to society than over 70% of the people on the registry" no sweetie 70% of sex offenders have an "assault" along with the charge which means "your gone", I dont care if you have dinner with Jesus Christ once a week...If I determine your a danger to my neighborhood and your criminal history indicates it..Your gone..what about that you dont get??
