Rossmoor Stabbing Case Postponed

A hearing to determine whether there's enough evidence for the case against James Anthony Rivas, 18, to go trial was moved to Friday.

The case of a Rossmoor man accused of stabbing a female jogger multiple times was pushed back to Friday. 

A witness scheduled to testify today against 18-year-old James Anthony Rivas -- charged with the attempted murder of a Rossmoor jogger -- was working on another court case and wouldn’t be able to attend until afternoon, said Orange County Senior Deputy District Attorney Brett Brian.

With the witness occupied, Brian said, attorneys for the defense and the prosecution agreed to reschedule the hearing to Friday at West County Justice Center in Westminster. The hearing will determine whether there is enough evidence for the case against Rivas to go to trial. 

Prosecutors alleged Rivas tried to kill a 27-year-old Rossmoor woman on an Oct. 9 evening as she was jogging.

Brian said he felt just a strongly about his case against Rivas as he did the day before.   

Rivas defense attorney Mark Fredrick said he wouldn’t comment on the case “not yet,” but said he was hopeful they’d be able to go on with the hearing Friday.
